Objective Semiotica is published in six annual issues, in two languages (English and French). KeaneyThe General ContextA popular medium of elementary Byzantine education in grammar and orthography was the genre known as.1 The genre is represented by a (larger or smaller) collection of (brief passages of prose [most frequently] or verse). The individual words of the text are accompanied by a fourfold analysis: (1) interlinear glosses;2 (2 and 3) grammatical and etymological/derivational analysis (...) of individual words; (4) a list of words beginning with the same two or three letters as the word analyzed-each word may or may not be glossed. While these lists quote some well-known texts, the grammatical analyses preserve only two quotations of classical authors; both, by some chance, are of Sophocles.3Our earliest, and necessarily very incomplete, knowledge of the genre comes in references and allusions thereto, like those of Anna Comnena (Alexiad 15.7) or Eustathius (e.g., Comm. in Hom. In lieu of an abstract, here is a brief excerpt of the content:All was this land full fill'd of faerie," or Magic and the Past in Early Modern EnglandLauren KassellI.In 1625 Gabriel Naudé (1600–53), student of medicine and up-and-coming librarian, wrote a history of magic.1 Paracelsianism had been debated in France for decades, and in 1623 Naudé had lent his pen to the controversy following the hoax appearance of bills posted in Paris announcing the arrival of the Fraternity of (...) the Rosy Cross and the wonders they could provide. The impetus for Naudé's history of magic was a pamphlet that described Homer and Virgil, abusively, as magicians. As Didier Kahn has shown, Naudé's 1623 intervention against the Rosicrucians wrested a brewing dispute about Paracelsianism from the hands of theologians and settled it in the name of reason, not religion; his medical training no doubt informed his intervention.2 In his history of magic Naudé complained that everyone who ever did anything clever was now reputed to be a magician, which meant in league with the devil. His project was to clear the ground of the [End Page 107] false histories that had been written for the previous two hundred years. Adopting a mode of historia litteraria, he redeemed the reputations of several dozen learned men—including Zoroaster, Socrates, Roger Bacon, Agrippa, and ultimately Virgil—whose names had been sullied by the term magician.3The branding of natural philosophers and especially mathematical practitioners as magicians had been an enduring problem.4 As John Aubrey would later reflect in notes on the life of the Oxford scholar Thomas Allen, "In those darke times Astrologer, Mathematician, and Conjurer, were accounted the same thing."5 But Naudé provides an elaborate account of why these accusations initially might have been fabricated—jealousy, incredulity, malice, fear of technology—and demonstrates a method for unmasking these errors. Follow the simple rules of good scholarship, he insists: read the best authors, think logically, and acquire "a certain familiarity with the most profitable Sciences, and the most universal and general account of the affairs of this World that may be had, which is to be gained partly by our own industry, partly by the endeavors of those who have gone before us, such as may be those of Historians."6 That is, through hard work and the help of other historians, understand the context in which these texts were written. Perfect historians are indispensable; false historians should be read with caution.7 If one encounters a fabulous tale, locate its textual sources, read critically, and remember that (many) historians vend rubbish.8 Naudé surveys a vast literature dating from antiquity through the sixteenth century, demonstrating that misreadings of tropes and irony, for instance, have led to the labeling of poets and natural philosophers as magicians.9 Likewise, where people have professed their magical powers, Naudé is careful to show that writing books about magic and boasting about one's expertise are not the same thing as practicing magic.10 These fables persist because authors repeat what others have written without applying the above principles of good research; they write for their own glory instead of doing proper research; and they show off their polymathic skills by assembling great [End Page 108] heaps of examples instead of making sense of them. Thus the noble name of history is built upon a monstrous edifice of fables.11In short, prompted by festering occultism and religious controversies in Paris, Naudé wrote a history of magic in order to release the great men of learning from the label of magician. This is a history of the "first appearance of learning, the first rising of the great wits, the time they flourished, the ages which have brought forth most, and take notice by the way, how that ignorance hath always persecuted them with this calumny"; he defines magic historically.12 Great learning and suspicion of its demonic sources are inseparable. In this essay, we aim to help clarify the nature of so-called 'occurrences' by attributing distinct modes of existence and persistence to processes and events. In doing so, we break with the perdurantism claimed by DOLCE’s authors and we distance ourselves from mereological analyzes like those recently conducted by Guarino to distinguish between 'processes' and 'episodes'. In line with the works of Stout and Galton, we first bring closer (physical) processes and objects in their way of enduring by proposing (...) for processes a notion of dynamic presence (contrasting with a static presence for objects). Then, on the events side, we attribute to them the status of abstract entities by identifying them with objects of thought (by individual and collective subjects), and this allows us to distinguish for themselves between existence and occurrence. [Review] Mieke Roscher, André Krebber, and Brett Mizelle, editors. Handbook of Historical Animal Studies. Berlin: Walter de Gruyter, 2021. 637 pp. In their introduction to the volume under review, ‘Writing History after the Animal Turn? An Introduction to Historical Animal Studies’, which uses Harriet Ritvo’s 2007 article ‘On the Animal Turn’ as a key reference point, the editors describe as follows the main goal of and broader rationale for the book: "the discourses of human-animal studies and historical animal studies, (...) just like all the other disciplines involved in the reevaluation of the lives of animals and our relationship with them, past and present, are not identical. Rather, they inform one another. What we aim at with this handbook, then, is to gather and make accessible the contribution of historical research to the field of human-animal studies as well as the contribution of human-animal studies to the study of history. History as a discipline and scholarly venture, in other words, can no [more] ignore animals than animal studies can history.". As the editors and also a number of the contributors underscore, however, to bring about this rapprochement between animal studies and history, it is not enough to study ‘the lives, experiences, and deaths of animals [as] a powerful lens to understand and explain human histories, ideas, and practices’, even if in the recording and interpretation of history humans remain ‘an omnipresent factor’. This article examines the values that underlie notions of sustainability and corporate social responsibility, and how those values influence perspectives on who and what is included in decision-making. The author argues that the epistemologies of economic considerations in industrial practices, and how they are framed by science and technology, make it unlikely that practices towards sustainability will successfully avert expanding global crises unless the circle of inclusion is expanded to include other-than-human life.

In recent decades, interest in the history and philosophy of the natural sciences has increased significantly. This interest has made scholars aware of the existing knowledge gap in these areas and has brought a kind of 'pressure' for more articles and books on the subject. Indeed, it also motivates academics to start new projects related to these disciplines. Volumes like this are much needed for scholars in the field, given the high amount of information they contain. In order to achieve this goal, this work contains thirteen articles related to the reception of the Persian philosopher's thought in these areas in the Middle Ages. The book revolves around the three different languages and cultures which were crucial for the reception of Avicenna's thought. Hence, the volume is arranged in three main sections focusing on the Arabic, Hebrew and Latin traditions. It also contains an Index of Avicenna's Works with Passages Cited and an Index of Names. The introduction is rather short compared to other sections of the book. It covers the general topics presented in the volume. The first six chapters deal with the Arabic tradition ; the next two have to do with the Hebrew reception of Avicenna, and the last five analyse the Latin reception of Avicenna's physics and cosmology. A recent judgment by a lower court in Germany brought the problem of ritual male circumcision to the consciousness of the wider public and legal academia. This essay weighs in on this emerging discussion and argues that ritual male circumcision is not covered by parental authority. It first considers and dismisses the best interest of the child test, which is the most widely used test of parental authority in legal practice. Instead, the essay proposes what it terms the (...) autonomy conception of parental authority, according to which parental authority must be exercised such as to ensure that the child will become an autonomous adult. While parents may raise their child in line with their ethical, including religious, convictions, respect for his autonomy requires that this be done in a way that allows the child to later distance himself from these values; this implies, among other things, that irreversible physical changes are impermissible. For some modal fixed point logics, there are deductive systems that enjoy syntactic cut-elimination. An early example is the system in Pliuskevicius [15] for LTL. More recent examples are the systems by the authors of this paper for the logic of common knowledge [5] and by Hill and Poggiolesi for PDL[8], which are based on a form of deep inference. These logics can be seen as fragments of the modal mu-calculus. Here we are interested in how far this (...) approach can be pushed in general. To this end, we introduce a nested sequent system with syntactic cut-elimination which is incomplete for the modal mu-calculus, but complete with respect to a restricted language that allows only fixed points of a certain form. This restricted language includes the logic of common knowledge and PDL. There is also a traditional sequent system for the modal mu-calculus by Jäger et al. [9], without a syntactic cut-elimination procedure. We embed that system into ours and vice versa, thus establishing cut-elimination also for the shallow system, when only the restricted language is considered. (shrink)

Ethical leadership research has primarily relied on social learning and social exchange theories. Although these theories have been generative, additional theoretical perspectives hold the potential to broaden scholars’ understanding of ethical leadership’s effects. In this paper, we examine moral typecasting theory and its unique implications for followers’ leader-directed citizenship behavior. Across two studies employing both survey-based and experimental methods, we offer support for three key predictions consistent with this theory. First, the effect of ethical leadership on leader-directed citizenship (...) behavior is curvilinear, with followers helping highly ethical and highly unethical leaders the least. Second, this effect only emerges in morally intense contexts. Third, this effect is mediated by the follower’s belief in the potential for prosocial impact. Our findings suggest that a follower’s belief that his or her leader is ethical has meaningful, often counterintuitive effects that are not predicted by dominant theories of ethical leadership. These results highlight the potential importance of moral typecasting theory to better understand the dynamics of ethical leadership. (shrink)

This introduction to the special issue on impact investing applies the attractive nuisance notion to impact investing. Social sector actors ‘trespassing’ on the playing field of conventional investment markets may not appreciate the risks. We apply the framework of essentially contested concepts to foster fruitful diverse research in this emerging research field. We advance six dimensions, which we propose allow to describe different sub-clusters of how the term is used in research and practice. For each dimension we identify (...) risks and opportunities stemming from the contested nature and highlight an ambitious research agenda for how future business ethics scholars can help address and foster impact investing. In a letter to Frege of 29 December 1899, Hilbert advances his formalist doctrine, according to which consistency of an arbitrary set of mathematical sentences is a sufficient condition for its truth and for the existence of the concepts described by it. This paper discusses Frege's analysis, as carried out in the context of the Frege-Hilbert correspondence, of the formalist approach in particular and the axiomatic method in general. We close with a speculation about Frege's influence on Hilbert's later (...) work in foundations, which we consider to have been greater than previously assumed. This is a finely edited editorial project, which summarizes the work of more than two decades done by a group of scholars—the Colombian School—lead by Fernando Zalamea, a pioneer of Peirce studies, and pragmatism in general, in Latin America.The structure of the volume unfolds in three dense chapters, each corresponding to a specific mathematical context connected to various aspects of Peirce's work. Broadly speaking, in the first chapter, Gustavo Arengas proposes the theory of higher category theory as a natural framework to represent the main traits of Peirce's semiotic; in the second chapter, Francisco Vargas develops a thorough set-theoretical model of Peirce's continuum; in the third chapter, Arnold Oostra, in a truly Peircean spirit, formalizes the notion of Intuitionistic Existential Graphs, emphasizing the idea that intuitionistic logic is the most natural context to represent and understand Peirce's diagrammatic logic. The fourth and last chapter, penned by Zalamea, provides the reader with a solid summary of the main results presented in the volume along with a robust road map to navigate through the technical details of the text.Mathematics, as implied by the title of the volume, is at the core of this project, and the authors do not shy away from the complexity, details, and depth of it in order to shed light on some of the most fundamental and groundbreaking nature of Peirce's ideas. That level of rigor and formal soundness is certainly one of the strengths of the volume, although readers who may not be acquainted with at least some basic notions of category theory or with the mathematics of Peirce's work, may find some of the text a bit terse—this is not a casual reading and it does require a certain level of commitment in order to appreciate the depth of the provided insights. On the other hand, all the background material is clearly laid out, making the volume a self-contained work which can be thoroughly enjoyed by a general audience.The real upshot of recasting some of Peirce's intuitions within the fabric of formal mathematics is not only that of providing the instruments to clarify those ideas, but also that of highlighting the role that Peirce's work has been playing in the development of modern mathematics in many relevant aspects, from the very genesis of category theory—which today is widely regarded as a necessary and unifying language in several fields of the mathematical and physical sciences—to the development of non-standard analysis, just to mention a few of them.An elegant instance of such perspective is offered by Gustavo Arengas in the first chapter, where it is argued that ∞-categories can be used to model the natural order of hierarchies implicit in Peirce's conception of the basic triadic relation between sign, object, and interpreter. The phrase of ceteris paribus , i.e., other things being equal, is widely employed to state laws in non-basic sciences, such as economics, medicine, geography, biology, and psychology. However, what the phrase in question says is highly unclear, which results in severe philosophical problems calling into question the status of special sciences. The main purpose of this paper is to critically examine a lexicographic study of cp proposed by Michael Morreau , who tries to provide an adequate semantic analysis (...) of cp-laws through this study. It is argued that, despite Morreau’s attempt to excavate meanings possibly contained in a cp-phrase, his proposal is very limited in the progress it makes. Toward the end of this paper, an alternative approach is sketched, in which the pragmatic role played by cp in the sciences is emphasized. (shrink)

The chosen format is a Denkschrift, that is, a memorandum in the sense of a document that experts lay out for their government to ponder. Perhaps, Pozzo suggests, the history of philosophy could even have an impact on economic authorities and policymakers. Indeed, the work seems driven by the laudable aim of promoting access and equality around the world. The author reveals a just concern for migrants in particular, since they bring [End Page 156] with them their intellectual traditions and philosophical texts, which can be translated and thereby foster intercultural dialogue.The book consists of an introduction (chapter 1) followed by nine chapters. It has a thirty-page references list as well as subject and name indexes. In part one, Pozzo argues for the need for new narratives in the history of philosophy (chapter 2), in order to establish its role in addressing migration (chapter 3). The second part concerns reflective society (chapter 4). It considers societal readiness (chapter 5) and cultural innovation (chapter 6). Part three explores the paradigm shift from a close reading of texts to a "distant" reading of corpora (chapter 7), a shift Pozzo endorses. It examines implications for the translation of languages (chapter 8) and the translation of studies (knowledge) and competencies (chapter 9). Chapter 10 concludes by briefly reflecting on the notions of the "fluidity" of peoples and their ideas, biodiversity (and food), and spiritual humanism based on dignity.Scholars in the history of philosophy "should be open to the idea of a pluriversum of a history of facts and places, whereby history of philosophy finds its grounding in spatial heterogeneity." Nowadays, when people migrate and transfer competencies at increasing velocity, the "history of philosophy can be usefully reinvented on the basis of its consideration of intercultural dialogue." Pozzo considers the World Digital Library to be "one of the most exciting examples of corpora that talk to each other"—an idea he uses not merely metaphorically. By "corpora" is meant not just the sum of separate books, but XML-accessible complete collections of traditions of texts, with corresponding dictionaries, thesauri, and reference works, which make it possible to analyze a number of original texts as well as transliterations into other alphabets or hanzi characters. The result would be a "data-driven" history of philosophy.Given that history of philosophy is a product of culture, it is influenced by migrating peoples, who bring philosophical ideas and religious traditions with them. Research on migration thus ought to also consider translations of texts and competencies from one to another context, be it linguistic, economic, political, or cultural. The humanities, and a reflective society more generally, might provide a partial basis for intercultural dialogue. Rawls strictly distinguishes between political or neutral conceptions of Liberalism and liberal justice on one hand side and moral or metaphysical on the other. His claim is, that a political understanding of Liberalism and justice has to be and could be free standing, independent of special conceptions of a good life. First of all this work shortly presents the main topics of Rawls’ Political Liberalism. Next, it formulates an antithesis: the political integration of plural modern societies does not depend (...) on an „overlaping consensus“ but on a strong liberal ethos, i.e. a political and metaphysical conception of a liberal way of good life. Furthermore I consider external objections and discuss internal problems of Rawls’ political philosophy. Finally it will be shown, that the description of an original position, given by Rawls, especially the metaphorical „veil of ignorance“, presupposes a certain „metaphysical“ concept of person, that includes what it means to lead a good life from a liberal point of view. ABSTRACT The 17th Biennial INPE Meeting was scheduled to take place from 28 to 31 July 2020 at the Universidad Nacional Autónoma de México. Of course, there is something ironic about convening a conference on the environment and sustainability that would require presenters to utilize unsustainable modes of transport in order to participate. As it turned out, because of the outbreak and rapid global spread of a new Corona virus, the conference was cancelled and replaced by an online event held (...) on 7 and 8 November 2020, both premieres in the history of INPE. The essays collected in this Special Issue will hopefully contribute towards the unmasking and undoing of the various kinds of denialism that have held us in its grip and that continues to thwart attempts to establish a sane and morally sustainable set of relationships between us, human beings, and other animals and the animate and inanimate environment. The increase in violence in South African schools, as elsewhere, has been associated with a general 'decline in moral values'. There have been three different responses that emphasise the decline in religious teaching at schools, the loss of traditional values like ubuntu , communalism and the like; and humankind's increasing alienation from nature. In other words, in terms of teaching and learning initiatives, we should turn to religion, community and the common good and nature (the natural environment and nonhuman animals) (...) in order to feel the force of morality and, consequently, to counteract human violence and cruelty. After critically examining these responses, the present article focusses on the third as the most promising, albeit one that is in need of re-conceptualisation. We need to teach not as if nature mattered but that it matters. Concepts and principles like justice, equality and rights have worked in the past. They have been useful in governing and regulating relations between human individuals. Indeed, it is the recognition of and respect for rights that best exemplifies the transculturality of values. Taking these concepts and principles seriously requires extending and employing them beyond the human realm. This may well be the most reliable way of halting the rapid deterioration of the world. Humane education, insofar as it incorporates guidance in moral reasoning and critical thinking - over and above nurture of appropriate feelings in individuals - and engages both rationality and individual responsibility, consists of transmission as well as in transcendence of our moral and cultural heritage. 'Decline in moral values', then, is counteracted by an approach that combines caring with respect for rights, in order to contribute towards erasing what has been called 'the ultimate evil', namely human violence and abuse. Environmental education and humane education, so re-conceived, arguably have long-term benefits for both humans and nonhumans. (shrink)

This study aims to identify research trends of scaffolding in the field of science education. To this end, both descriptive analysis and co-word analysis were conducted to examine the selected articles published in the Social Science Citation Index journals from 2000 to 2019. A total of 637 papers were retrieved as research samples through rounds of searching in Web of Science database. Overall, this study reveals a growing trend of science educators' academic publications about scaffolding in (...) the recent two decades. In these sample papers, from 1,487 non-repeated keywords, we extracted 286 author-defined keywords shared by at least two studies as a benchmark dictionary. A series of co-word analyses were then conducted based on the dictionary to reveal the underlying co-occurring relationships of the words in title and abstract of the sample papers. Results showed that “scaffolding,” “support,” and “design” were the top three most frequently used keywords during 2000 and 2019. Visualization of co-word networks in each 5-year period further helps clarify both educators' common research foci and relevant research trends. Auditory scene analysis is an elementary aspect of music perception, yet only little research has scrutinized auditory scene analysis under realistic musical conditions with diverse samples of listeners. This study probed the ability of younger normal-hearing listeners and older hearing-aid users in tracking individual musical voices or lines in JS Bach's The Art of the Fugue. Five-second excerpts with homogeneous or heterogenous instrumentation of 2–4 musical voices were presented from spatially separated loudspeakers and preceded by a short cue for (...) signaling the target voice. Listeners tracked the cued voice and detected whether an amplitude modulation was imposed on the cued voice or a distractor voice. Results indicated superior performance of young normal-hearing listeners compared to older hearing-aid users. Performance was generally better in conditions with fewer voices. For young normal-hearing listeners, there was interaction between the number of voices and the instrumentation: performance degraded less drastically with an increase in the number of voices for timbrally heterogeneous mixtures compared to homogeneous mixtures. Older hearing-aid users generally showed smaller effects of the number of voices and instrumentation, but no interaction between the two factors. Moreover, tracking performance of older hearing aid users did not differ when these participants did or did not wear hearing aids. These results shed light on the role of timbral differentiation in musical scene analysis and suggest reduced musical scene analysis abilities of older hearing-impaired listeners in a realistic musical scenario. Kohl and Nimmerfall, two legal scholars from the Faculty of Law at the University of Vienna, have put forth an edited volume dealing with ‘law and language in practice’. In this article, I present a critical evaluation of the work, taking into consideration its structure and organisation, the range and depth of the work, and the construction of and perspectivation on legal language in use and the legal language user. I do so from the interdisciplinary view of legal linguistics (...) and social semiotics, two areas of critical intellectual inquiry that are doubtlessly underrepresented in this volume. While legal linguists in Austria have anticipated the work as a hopeful bridge-builder across the domains of law and language, Kohl and Nimmerfall display a lack of awareness towards ongoing controversies in legal linguistics on the national and international level that seriously jeopardise the aim of the work. Currently the volume is being used in a course held by the authors entitled “Legal Literacy: Contract drafting, legislation and other areas of law”. Despite the work’s breadth of legal contexts touched upon and its undisputed worth for the community of practice, the work gives a sometimes disconcerting impression of authority in the field. While the authors’ openness to embracing language issues in legal contexts ought to be welcomed, the nearly complete lack of references made to the ever-growing body of research in legal linguistics, not only in Austria but around the globe, is surprising and concerning. Ce questionnement se veut d'être une voix parmi d'autres et non la seule voix représentative du VietnamThis article’s aim is to ask questions about the attitude that should be adopted by Vietnam, a French-speaking country bearing its "heavy" colonial past. After so many events and delays caused by the war, the country is now interested in catching up with the train represented by the rest of mankind which is moving forward. The question is thus to define the attitude Vietnam could adopt towards itself, towards the Other and the other culture. Thus, this article has made use of certain notions of interculturality, analyzed the way in which Vietnam has managed relations with itself and with the Other, and proposes an attitude for each country to adopt in the French-speaking Community and in reaction to globalization. The complexity and emotional/psychological responses to the environmental challenges of the 21st century has led to the coining and development of new words and concepts that, for some people, better describe how they are personally grappling with anthropogenic ecosystem damage and climate breakdown. This paper identifies some of the more commonly used environmental neologisms within scholarly literature and evaluates their usefulness and contradictions for those influenced by the virtue ethics promoted by the ancient Stoics and the Catholic Church. We (...) find that environmental neologisms, when framed by these philosophical and/or theological ideas, offer an alternative and, ultimately, helpful means to contemplate the nature of what might be considered an environmental crisis and how best we might address, or at least, mitigate it, as conscientious spiritual human beings. This article proposes a 'fusion of horizons' in constructing urban public theologies in South Africa. This is done through the introduction of five interrelated themes that have emerged from the on-going knowledge and idea production by a distinguishable counterpoint in contemporary scholarly, intellectual and activist engagement with the urban, in the authors' own South African context but also wider internationally. In advancing a praxis-agenda for urban public theology, the authors subsequently identify the following, albeit not exhaustive, themes: southern (...) urbanisms and the factor of unprecedented urban migration; 'right to the city' and urbanisation from below; a reclaiming of the commons; the making of 'good cities'; and actors of faith in relation to urban social life. The more passages one examines in the translations from Arabic to Latin and from Arabic to English and other modern languages, the more mistakes one comes across in the translation of the Arabic expression ‘alā al-qaṣd al-awwal . The mistakes stem from the failure to distinguish between two senses of the expression, one an adverb, and the other a famous philosophic concept. Failing to distinguish between the two senses, the translators translated the phrase literally, often with unsatisfactory results. In (...) class='Hi'>this paper, I shall indicate a Greek word which was rendered by the Arabic ‘alā al-qaṣd al-awwal. I shall refer to some English translations from the Arabic and show how wrong they are. I shall suggest that in Arabic philosophy itself al-Fārābī, rather than Avicenna, may have been the origin of the philosophic concepts of “first and second intentions.” I shall point out that although these concepts may have been introduced into Latin scholasticism by Raymond Lull, he could not have derived them from the Logic of al-Ghazālī, as has been alleged. This article considers current advances in tattooing that are challenging community-held views of authorship and ownership, and the need to address this tension. The key challenge is from AI-generated artworks being used as tattoo designs, but the authorial role of the tattooist is also challenged by body art projects such as tattoo collection. Legal clarity for tattooing is lacking, and in addressing this, this article advocates for an open, community-based form of shared copyright ownership and authorship (...) for projects as tattoo collecting, drawing on Dusollier’s and Mendis’ work. This article contributes to both copyright and cultural heritage legal scholarship, and to tattooing scholarship and the tattooing community. AI-generated art being tattooed on people has not been explored in the literature to date, and this article fills this gap. Furthermore, this article contributes a pilot study of the tattoo community’s views on AI-generated tattoos, which is currently lacking from the scholarly debate on AI-generated art. This article argues that the debate within the tattoo community about AI-generated art being used in tattoos needs to be addressed within the community through agreed extra-legal norms, which may well depart from how copyright law decides to approach AI-generated art globally. This article also asserts that AI should _not_ be regarded as the “author” of tattoo works in the traditional copyright sense, as only a human tattooist can draw from a number of cultural, textual, audiovisual and visual, cultural folklore, history and mythical references in creating their tattoo designs, as well as drawing on the client’s personal stories. This article explores the following: (i) an understanding of tattooing as an artform; (ii) tattoos in UK copyright law; (iii) an exploration of the authorial role of the tattooist within tattooing; (iv) the authorial role of the tattooist within tattoo collecting; (v) AI-generated tattoos—perspectives from the tattoo community, through a pilot study of YouTube videos and viewer comments about this; and (vi) a consideration of whether copyright legal reform is the solution for the tattooing community. ‘Authority’ is a term widely used in scholarly debate, including the history of philosophy. However, what is meant by this term is not always clear and the concept is not very well defined. One reason for this is certainly that the phenomenon itself is complex and the corresponding terms are used with a degree of latitude. This makes it difficult to adequately compare and connect the insights that various case studies have to offer. For historians of philosophy, (...) it is thus important to get a sufficient grasp of the concept of authority. This is even more urgent when one studies commentary traditions, in which secondary texts are written in virtue of the existence of texts clad with high authority. Our article combines historical textual research with insights from epistemology, thus providing a discussion of the concept of authority and its importance in textual traditions. We propose a descriptive model that can be used for examining epistemic authority in historical texts. An example from ancient Platonism serves to show both the complexity of the phenomenon and the clarifications that our approach may offer. (shrink)

Scholars of Jewish history have paid consistent and devoted attention to the Barcelona Disputation of 1263. Records of this event preserve contemporary Jewish and Christian responses to the proceedings, which pitted Nahmanides, the most important exegete and teacher of the region, against a convert from Judaism to Christianity, took place in the royal court before an illustrious audience. This essay traces trends in scholarly treatments of the Barcelona Disputation from the early days of the Wissenschaft des Judentums to (...) the present. By examining challenges of veracity posed by the documentary sources as well as foundational assumptions about what the medieval authors intended to achieve with their accounts, this article provides broad overview of the historiography that has developed around the Barcelona Disputation. The theme of this issue of Ethical Perspectives is the French tradition in liberal thought, and the unique contribution that this tradition can make to debates in contemporary liberalism. It is inspired by a colloquium held at the Katholieke Universiteit Leuven in December of 2008 entitled “In Search of a Lost Liberalism: Constant, Tocqueville, and the singularity of French Liberalism.” This colloquium was held in conjunction with the retirement of Leuven professor and former Dean of the Institute (...) of Philosophy, André Van de Putte, who found much inspiration in this tradition. A revised version of his valedictory lecture from the conference serves as the final contribution to this issue. Much contemporary liberal political philosophy is currently done in conversation with a line of liberal thinkers starting with John Locke, running through Immanuel Kant and John Stuart Mill, and culminating in the work of John Rawls and his followers. The reasons for the enormous appeal of this philosophical tradition are, among other things, the combination of the central role of the intuitively appealing value of individual liberty with a strong rationalistic, universalistic, and normative character. The thread running through most of these liberal theories is a commitment to what the French liberal Benjamin Constant referred to as “the liberty of the moderns,” that is, liberty in a negative sense, as a lack of interference in one’s activity from others and from government. This focus has expanded over time to include a richer body of civil, political, social, economic and cultural rights, for instance, in the work of liberal thinkers who have tried to integrate the insights of communitarian thought and discourse ethics in their work. However, the emphasis on individual liberty in the negative sense continues to be the normative and theoretical touchstone and default position for many contemporary liberal theories. The limitation of the canon of liberal thought to the aforementioned authors and themes deprives the contemporary debate of a rich source of ideas: the French liberal tradition. Montesquieu, considered to be the father of this tradition, provides a good example of how it can enrich current debates in liberal theory. Montesquieu’s work evinces a keen eye for the dynamics of power relations and the limitations of the power of the better rational argument. His insight that power can sometimes only be checked by an equal and opposing power, so that a system of separation and balance of powers is necessary in order to preserve liberty, is reflected in the foundations of most modern democracies. Montesquieu also argues that contingent environmental, historical, social and economic conditions play a dramatic role in determining what kind of government is appropriate for a particular society. On his view, ignoring these facts when framing a government can inadvertently end in despotism. Montesquieu’s observations challenge us to reexamine some of contemporary liberalism’s universalist and rationalist claims. Benjamin Constant is most famous for his distinction between two kinds of liberty: the liberty of the ancients and the liberty of the moderns. The ancient form of liberty manifested itself in the active political participation of citizens in the ancient republic. While this form of government and decision-making was suitable for small, homogeneous city-states, Constant argues that it is impracticable for large modern nation-states. Hence, the concept of modern liberty shifts to an emphasis on the rule of law and the non-interference of the state in private matters. This form of liberty is familiar to us from contemporary liberalism – and Constant cherishes this form of freedom as much as any liberal does today. However, his position is complex: he also argues that the liberty of the ancients should not be neglected. Active political participation is needed to ensure that the government is executing its duty of preserving the modern form of liberty by publicly pointing out violations. The contemporary relevance of Constant’s work is clear when we consider the alleged “democratic deficit” that plagues the EU and international institutions such as the UN, the IMF, and the World Bank. Not only does this democratic deficit threaten the modern form of liberty by placing decision-making processes out of sight of the people, it also threatens citizens’ sense of self-respect derived from self-governance. Constant’s argument for the necessity of combining the liberty of the ancients with that of the moderns provides a fruitful resource for confronting these contemporary issues. Tocqueville’s work on liberalism benefits from his opportunity to observe a society founded on liberal democratic principles – the United States of America – in action. In his Democracy in America, he examines the social consequences, both intended and unintended, of building a society on ‘the equality of conditions’, as he defines ‘democracy’. Tocqueville sees a tension between the democratic value of equality and the aristocratic value of the rule of the best. He observes that democratic societies do not necessarily choose the best leaders and instead promote mediocrity instead of virtue, talent, and excellence. Democracy also confronts citizens with the threat of ‘soft despotism’, where a government that preserves the outer signs of the liberty of the moderns nevertheless controls the behavior of its citizens in minute detail through a system of detailed rules ostensibly aimed at their welfare. This paternalism is an even more insidious threat to liberal values than the hard variety of despotism, since it is so difficult to detect and done in the name of liberal values themselves. Taking Tocqueville’s observations seriously would add complexity to attempts to theorize about the modern social-democratic welfare state. The contributions to this issue supplement and critique mainstream liberal thought and its relation to contemporary issues through a serious engagement with the French liberal tradition. Annelien De Dijn’s contribution discusses Bertrand de Jouvenel, a lesser-known 20th Century representative of the French political tradition she terms ‘aristocratic liberalism’. This tradition has its roots in the work of Montesquieu, and emphasizes the importance of intermediary bodies, most importantly the aristocracy, in providing a check to the top-down power of despotic state authorities and the bottom-up power of revolutionary leveling tendencies, both of which threaten liberty. De Dijn situates Jouvenel in this tradition, but then indicates an important difference between his thought and that of his predecessors: his most significant work, On Power, is not only on French history, but on European history. Pointing to the enthusiastic reception of this work in the Anglophone world, she suggests that the rise of totalitarianism in Europe gave the anti-totalitarian features of aristocratic liberalism a broader appeal. Valentino Lumowa’s paper concerns Constant’s classic text, The Liberty of the Ancients Compared with that of the Moderns. Lumowa argues that in order to understand Constant’s piece, we must be aware that its two parts were written under different historical circumstances and decipher the argumentative thrust inherent in the text. Following Stephen Holmes, he argues that to understand the shift Constant made in the second part of the text, we should read it within the context of the increasing influence of the ultra-Royalists in the legislature during the Bourbon Restoration. However, in contrast to Holmes, he contends that the spirit of both civic and individual freedom, which enlivens representative system, is the backbone of the text in its unity. Demin Duan’s essay investigates an apparent ambivalence between liberal and imperialist tendencies in the work of Alexis de Tocqueville, which has already drawn some attention from Tocquevillian scholars. These interpretations of Tocqueville and his writings on empire generally agree that Tocqueville stands in a recognized tradition of liberalism, which is characterized by respect for human rights, individual freedom and a sense of universal humanism. On this standard view, Tocqueville’s support of imperialism represents nothing but an unfortunate breach of his own otherwise consistent liberal thinking. Duan’s article questions this standard position. By questioning the assumption of Tocqueville’s liberalism in the first place, he tries to gauge the influence of both the old republican tradition and the new liberal perspective on his thinking. In conclusion, he argues that Tocqueville’s overall thought, especially his notion of freedom, is very much informed by an old republican tradition. His support of French imperialism could be better understood from this perspective rather than be rendered simply as a deviation from liberal norms. Pawel Marczewski’s contribution is an attempt to show that Tocqueville’s conception of liberty transcends the divisions between negative and positive aspects of freedom. He begins by juxtaposing this conception with the opposition drawn by Constant between liberty of the ancients and liberty of the moderns. While Tocqueville and Constant shared a concern for the preservation of individual rights, Tocqueville was much more reluctant to accept the modern loss of the communal dimension of liberty. He did not accept the view that jouissances privées, private pleasures, are the main compensation that the modern world has to offer for the lost ancient treasure of political participation. The essay then looks into the relevance of Tocqueville’s standpoint for current debates between liberal defenders of negative freedom and republican advocates of freedom as non-domination. Participants on both sides of the debate seem to be so devoted to showing that their particular approach provides the best guarantees against actual and possible threats to liberty that they overlook the fact that their definitions of freedom remain significantly similar. By arguing that ‘to be free is to be guided by one’s own will’, contemporary republicans, as well as their liberal counterparts, move along the lines drawn by Constant towards private pleasures. By questioning the inevitability of this turn, Tocqueville provides us with a valuable contribution to these discussions in contemporary political philosophy. Finally, André Van de Putte’s contribution, an adaptation of his emeritus speech that closed the conference on French Liberalism, appeals to Tocqueville in order to draw attention to the importance of intermediary, dialogical bodies in mitigating the implicit despotic tendencies of the democratic drive to equality. In Tocqueville’s view, the transition from the feudal corporate inequality to democratic individual equality was not a clean break. Rather, this transition is a continual process of democratization that is driven by a desire for equality, or egalité des conditions. This dissolution of distinctions of estate, class and status has the unintended consequence of concentrating the diffuse power of these entities into a centralized state, which is responsible for ensuring the equality of all under the law. This process leaves increasingly isolated and atomized individuals to face the power of a monolithic state in defense of their freedom, and moves toward a soft, paternalistic despotism. Constant’s freedom of the moderns is not sufficient to protect individuals from this centralized power. Democracy also requires the political freedom of the ancients. Van de Putte argues for a system in which atomized individuals organize themselves into intermediary bodies that, in a Montesquieuian balance of powers, can enter into dialogue with each other and the state on more equitable terms. Van de Putte’s contribution closes with a plea for a conception of democracy as a regime of dialogue. (shrink)

In this paper I examine the conflicting ways in which Bertrand Russell and Hegel understand indexical expressions. For this purpose, I consider some books and articles written by Russell in different moments of his life, and the first chapter of Hegel’s Phenomenology of Spirit, book published in 1807. I try to show that Russell, even being a Hegel scholar, does not respond to his proposal about indexical expressions, but takes a position that keeps him trapped in (...) a kind of self-deception of sense-certainty. At the end, I suggest that the differences between Hegel and Russell in relation to indexical expressions can be explained by the fact that the ontologies adopted by both authors exclude each other. PurposeThe purpose of this paper is to show that most, if not all RFID/biometric passports have clear technical and social problems in their intended use and that there are clear problems with the databases into which biometric data are being collected, due to use of this data for other, non‐intended uses.Design/methodology/approachThe approach of this paper is both a meta‐study of the flaws in the technological specifications as well as the social implementation of RFID/biometric passports. Finland is used (...) as a case, but the results extend beyond Finland in most, if not all the topics presented – not necessarily all results to all implementations, but all to some others.FindingsThe current implementations of RFID/biometric passports are lacking in both technical and social implementations and pose clear risks to their use, both due to lax implementation of the technology itself but specifically due to the social changes brought about. These problems cause both erosion of privacy and trust.Research limitations/implicationsFurther research into other potential social implications on a national level is required. The authors fear that the cases presented do not necessarily reflect all the potential problems, but just the most evident ones.Practical implicationsThe problems with the technological implications can be averted by using the best technological solutions, and thus the best technological solutions should be used instead of the ones proven to be lacking.Social implicationsThe social implications should at least be brought forth for public discourse and acknowledged, which currently does not seem to happen.Originality/valueThe paper contributes to the understanding of problems with current RFID/biometric passport implementations as well as inherent social problems that are hard, if not impossible to avoid. The problems belong under the category of critical eGovernment applications, and similar issues are visible in other eGovernment applications. (shrink)

Female-entrepreneurship plays a significantly important role in rural areas of China today. In fact, it is a driving force behind inclusive economic development of the country as a whole. However, notably very little literature out there has focused on the impact of how widespread usage of information technology tools affects the mothers entrepreneurship in the outskirt regions. Here, in this paper, the authors attempt to explore the finer details of such an impact by utilizing the data from the 2017 (...) China Integrated Social Survey; along with the IV-Probit model to explore the transmission mechanism. Interestingly enough, it was discovered that Internet applications and tools do indeed increase entrepreneurship among women with children by a roughly 7.88%. In addition, this paper finds that the utilization of such “InfoTech” promote a continuous progress in entrepreneurship among those women with children who endeavor to start a self-managed enterprise in the less developed areas. Lastly, when looking the analysis of the transmission mechanism, this paper found that the role of Internet-usage in promoting rural mothers entrepreneurship was mainly through three factors – the gender equality effect, the information learning effect, and the financing effect. This accumulated data will be thoroughly presented here in the ensuing sections. (shrink)

This article reviews the outstanding and thought-provoking work by Roberta De Monticelli (2021), _Towards a Phenomenological Axiology. Discovering What Matters_. The article addresses the reasons why it should be read by everyone but especially by help professions practitioners. Although we all deal with morality and value judgments on on mundane, everyday bases, the professional life of education and care practitioners is namely a series of morally-loaded practices and decision-making informed by morally oriented (expert) knowledge. Beyond the thesis advanced in (...) the book, its major contribution consists in making the reader think the inescapability of morality in everyday thinking and acting and the need for a reflective positioning towards this issue. By aligning with “the hedgehog vs. the fox” struggle proposed by the author as the framework of her theoretical proposal, the article advances what would be the doubts and counterarguments of a fox-like scholar in education. It illustrates why her “professional vision” cannot but notice what appears to be under-thematized by the hedgehog, i.e., the unavoidable mediation of language and social interaction that _precedes_ and therefore impacts the constitution of what the hedgehog convincingly notices: the entanglement of fact and value. The conclusion is dedicated to the (underestimated?) place of social sciences in such a debate, their tension between implicit normativity and presumed descriptivity, as well the challenges of the increasingly explicit normativity of applied social sciences.
